MACSA Tekad Memperjuangkan Hak Orang Kurang Upaya

MACSA Remains Committed To Fight for the Rights of Persons With Disabilities

DECEMBER 3 is observed worldwide every year as International Day of Persons with Disabilities (PWD) to promote an understanding of disability issues and mobilise support for the dignity, rights and well-being of persons with disabilities. It also seeks to increase awareness of gains to be derived from the integration of persons with disabilities in every aspect of political, social, economic and cultural life. Even though the Malaysian government has affirmed its commitment to respect the vulnerable PWD group, there is still much groundwork to be covered by our country in ensuring that PWD are accorded their due rights. Malaysia signed the Convention on the Rights of Persons with Disabilities (CRPD) on April 8,2008 and ratified it on July 19,2010. The provisions and ...

EU has no right to impose values

The Malaysian Alliance of Civil Society Organisations in the Universal Periodic Review Process (MACSA) denounces the statement by the European Union (EU) spokesman on Nov 11, in response to the sentencing of five Muslim men in the Syariah High Court of Selangor for engaging in unnatural same sex conduct. Such a statement runs afoul of the moral and religious values that Malaysia holds dear as an Asian nation having regard to Islam’s position as the religion of the federation per Article 3 (1) of the Federal Constitution of Malaysia, and the syariah institutions that administer Islamic law, which is accepted as lex loci (law) of this land. The statement is also misleading and misconceived in that it purports to affirm specific human rights for LGBTQ persons under the Univers...

Expedite Amendments Of Employment Act To Protect Women

MACSA repeats its past demands for the Government to materialize its pledge for greater protection towards the employees in private sectors. It is pertinent now more than ever considering the acknowledgement by the Ministry of Human Resource that there is a huge gap within our laws, which has failed to provide the necessary protection for pregnant women seeking employment. Amend the Employment Act 1955 The promise for a comprehensive amendment to our Employment Act 1955 [Act 265] must be honored and addressed by the Government to ensure that women are neither discriminated by reason of their marital status nor for their religious belief nor for their ethnicities. The Malaysian Government has taken a bold move in declaring its commitment for inclusivity but this means nothing if women

Greater Ties between Islamic Authorities and Suhakam a Step Forward for Human Rights

The Malaysian Alliance of Civil Society Organisations in the UPR Process (MACSA) is elated to learn from media reports that closer ties have been fostered between the various Islamic religious departments throughout Malaysia and the National Human Rights Commission (SUHAKAM) as elaborated by one of its commissioners Dr. Nik Salida Suhaila Nik Saleh at the 20th anniversary forum of the latter hosted at the Istana Hotel recently. Indeed the whole purpose of human rights as adumbrated in the Universal Declaration of Human Rights 1948 (UDHR) is to argument and compliment the teachings of Islam which teach love and reverence for and obedience to a supreme creator higher then oneself and that the grant of such rights is by the authority of and subject to this creator of all humankind, and not...

Penang’s Deviation From Agreed LRT Alignment Contravenes Religious Liberty

Masjid Jamek Sungai Nibong Besar, built circa 1880, is among the oldest mosques in Penang and a historical symbol for the Muslim community in that heavily industrialised northern state. The mosque is located at the edge of Jalan Sultan Azlan Shah in Bayan Lepas which is one of the main routes used by the public within the city. The mosque is close to the Kompleks Medan Suri MPPP, Terminal Hentian Bas Ekspres Sungai Nibong and Tapak Pesta MPPP Sungai Nibong, which makes it a focal point for members of the public who stopover to do their daily prayers. Due to its location near the Bayan Lepas Industrial Zone, this centre of worship is the stopover of choice for government and private sector employees to perform prayers especially on Friday. Additionally, the mosque’s position next to the ...

Syazlin must be reinstated as counsel in Adib inquest immediately

The Malaysian Alliance of Civil Society Organisations in the UPR Process is concerned with the current turn of events pertaining to the inquest of into the death of fireman Muhammad Adib Mohd Kassim. It has been reported that independent counsel Syazlin Mansor who was appointed by the Housing and Local Government Ministry to represent the fire and rescue department has announced her withdrawal from the inquest allegedly of her own accord, but seemingly due to pressure exerted upon her from various quarters. We believe the circumstances leading to her withdrawal from the case to be fraught with anomalies, giving rise to reasonable suspicion that the inquest is being tampered with. This is especially so in light of testimony by forensic specialist Prof Dr Shahrom Abdul Wahid who was ca...

Numan must apologise, retract baseless claim on state sponsored violence against LGBTs

In response to the investigation by the police over Numan Afifi’s speech before the United Nations as a delegate of the International Lesbian and Gay Association on behalf of a coalition of Malaysian NGOs working on gender identity and sexual orientation issues, the Malaysian Alliance of Civil Society Organisations in the UPR Process (MACSA) defends the right of Numan to speak out on such issues, insofar as the same are based on facts and with appropriate evidence. This accords with the rights of human rights defenders in the UN Declaration on Human Rights Defenders. Further, free speech is protected by the Federal Constitution and all the international human rights instruments Malaysia accedes to including the Universal Declaration of Human Rights 1948 (UDHR), the Cairo Declaration of ...

MACSA welcomes Malaysia’s accession to the Rome Statute

The Malaysian Alliance of Civil Society Organisations in the UPR Process (MACSA), a coalition of 52 civil society organisations, welcomes the accession to the Rome Statute by Malaysia, which shows the continued commitment of all segments of our multi-ethnic society to promote justice and rule of law without fear nor favour in the fight against callous impunity, in particular for war crimes, crimes against humanity, genocide and the crime of aggression. We congratulate the substantial efforts of civil society organisations, parliamentarians, the Government and the media, whose joint commitment to this end was crucial to move forward the entire process that led today to the achievement of this result. Malaysia’s accession to the Rome Statute, which brings the total tally to 3 out of 10...

Suhakam And Bar Council Must Not Shirk Joint Responsibility To Ensure Freedom Of Assembly In New Malaysia

The Malaysian Alliance of Civil Society Organisations in the UPR Process (MACSA) is deeply concerned to note that the organisers and participants in the planned rally against the International Convention on the Elimination of Racial Discrimination (ICERD) to be held this coming weekend remain without any official external monitors of their human right to peacefully assemble nor are able to accept any offers of legal advice in the safeguarding of such a right. This is despite the green light for the rally issued by the relevant authorities such as the Police and the Kuala Lumpur Assembly Hall (DBKL) and is so glaringly absent it has spurred our former Attorney-General, Tan Sri Mohamed Apandi Ali, to step in with offers of free legal aid for would be participants of that rally. MACSA a...
